Course Description 本課程為商標法之探討，以美國與台灣商標法為主軸。研討Lanham Act及我國商標法的相關規定、原理、及案例法的發展，使學生能具備對商標法的應用與研究的能力。本課程為進階課程，修課學生須具備對英文資料的閱讀能力；本課程以中文授課。

商標法是智慧財產權法之主要科目之一，本課程希望以較密集與整合之方式，提供修課學生對於商標法當前核心問題深入且全面性之學養訓練，期能對於我國產業當今所面臨的商標關鍵議題，培養修課同學之分析理解與提出解決對策之專業能力。
主要課程內容包括：
1. 商標權之取得
2. 商標之保護要件
3. 商標侵害
4. 商標淡化
5. 商標合理使用。
6.商標國際註冊。
7.歐盟商標法。
學習目標：
1. 掌握商標法法的重要制度環節，例如侵害判斷、合理使用、權利範圍認定與解釋、權利歸屬與授權、法律效果（權利救濟）以及競合適用等，其正確運作所應遵循的關鍵原則，以及現行法上之具體規定情形與實際運作狀況。
2. 清楚瞭解商標法的建制目的與保護功能，及其在權利保護與容許他人使用之間所達成的個案平衡，其基本的法政策究係何在？如何落實於具體制度層面？並且明瞭各商標使用與混淆誤認之虞彼此間之互動關係。
